$2.5 Million Settlement: Walmart Compensates 80,000 Workers for Health Screenings
Walmart Inc. will pay approximately $2.5 million to nearly 80,000 workers as part of a settlement in a wage-and-hour lawsuit over compensation for Covid-19 health screenings, according to the published article of Bloomberg Law. A federal judge Susan M. Brnovich granted final approval of the settlement on Monday ending over three years of litigation. The class action led by Kathy Arrison and Tristan Smith alleged that Walmart violated labor laws by not compensating employees for the time spent undergoing pandemic-related health screenings before clocking in for their shifts. The class includes Walmart workers employed in Arizona from April 2020 to February 2022. Judge Brnovich praised the settlement process noting that the negotiations were conducted in good faith and resulted in a fair and adequate agreement for the class members. The settlement addresses the plaintiffs’ strong case while also considering the risks and complexities of continuing litigation.
Brnovich highlighted the challenge of maintaining class status for over 80,000 Americans if the case went to trial. The agreement also allocates $625,000 for attorneys’ fees and over $118,000 for counsel reimbursements. Service awards of $5,000 will be granted to Arrison and Smith with the settlement administrator Simpluris receiving approximately $207,000. The legal representation for the class members was provided by Lear Werts LLP while Walmart was represented by Dentons US LLP and Akin, Gump, Strauss, Hauer & Feld. The settlement brings closure to the workers’ claims that Walmart failed to pay wages for time spent on health screenings and did not keep accurate records of related work. This resolution underscores the importance of fair labor practices and compensation especially during extraordinary circumstances such as the Covid-19 pandemic.
