Walmart Settles $45M Lawsuit Over Overcharging Claims in Florida

Walmart has agreed to pay $45 million to settle a class-action lawsuit in Florida, addressing accusations of overcharging for certain pay-by-weight items, including produce. The settlement, which awaits approval from the U.S. District Court in Tampa, offers eligible shoppers the opportunity to claim up to $500 each.

The lawsuit, filed by consumers who alleged that Walmart falsely inflated the weight of certain products, particularly those with price-embedded bar codes, covers purchases made between October 18, 2018, and January 19, 2024. Products included in the settlement range from meat, poultry, pork, and seafood to bagged citrus fruits like oranges and grapefruits.

Individuals seeking compensation must file claim forms by June 5, with the payout amount depending on factors such as the number of eligible items claimed and whether documentation like receipts is provided. Those without receipts may still receive compensation, albeit at a reduced rate.

Vassilios Kukorinis, a Tampa resident and lead plaintiff in the case, first raised concerns about overcharging at Walmart stores in Florida. His efforts, supported by legal representation from Morgan & Morgan, led to the class action lawsuit being filed in February 2019. Despite initial disputes over the settlement process, Walmart and the plaintiffs’ lawyers reached an agreement, pending court approval.

While Walmart has denied the allegations of overcharging, the company deemed the settlement to be in the best interest of both parties. The resolution of this lawsuit underscores the importance of consumer vigilance and accountability in retail practices.

In light of this development, affected shoppers are encouraged to review their purchases during the specified timeframe and consider filing a claim to receive compensation.
